Kielle is committed to transparent processing of personal data and, therefore, provides the following information.

Kielle GmbH, a company with its registered office at Südwestkorso 14, 12163 Berlin, Německo, registered at District Court of Charlottenburg (Berlin) HRB 218528 B (hereinafter “kielle”), operates a website at www.kielle.de (hereinafter the “Website”).  Kielle, as the personal data controller, uses all efforts to protect the privacy of all customers and other data subjects and guarantees confidential handling of all personal data it processes.

For the purposes of this notice, term User shall mean person who visited the Website or who contacted kielle by any means (e-mail, telephone, contact form).

The processing of all personal data of Users takes place in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, as amended, and other related regulations.

 

Processing of Users’ personal data

Kielle processes the Users’ personal data only for the purposes specified below. Users are not obligated to provide kielle with any of their personal data; however, collection and further processing of said data is necessary in case Users wish to make use of services or offerings provided by kielle via the Website. Also, data may be processed automatically due to merely accessing the Website to the extent outlined subsequently.

Kielle can process personal data both manually and by automated means.

 

1. Resolving queries and requests

Purpose:

Kielle processes personal data in order to maintain a properly functioning contact system that enables kielle a necessary exchange with its Users.

Type and extent of data processing:

In order to handle the User’s queries/contact request and deal with it, kielle processes the data provided by the User within this context, e.g. name, surname, telephone number, e-mail address and/or any other data as indicated.

Legal basis:

Kielle processes User’s personal data on the basis of its legitimate interest in allowing and maintaining an exchange with User’s to answer their queries and requests.

Storage period:

Kielle processes these personal data for the period of actively processing the request or query and, subsequently, for a further period of 5 years.

 

2. Compliance with kielle’s legal obligations

Purpose:

Kielle processes personal data for the purpose of fulfilling its own legal obligations being applicable in the respective individual case. 

Type and extent of data processing:

Kielle processes the Users’ data where legally prescribed for specific cases.

Legal basis:

Kielle processes personal data also on the basis of compliance with the legal obligations to which kielle is subject.

Storage period:

Personal data shall be processed for the period required by the relevant legal regulations.

 

3. Enforcement of kielle’s legal claims

Purpose:

Kielle processes personal data for the purpose of establishing, exercising or defending any supposed legal claims.

Type and extent of data processing:

In order to establish, exercise or defend legal claims, kielle may process any of the following User’s data in the individual case: name and surname or business name, address of residence or registered office, e-mail address, telephone number, identification number, tax identification number, date of birth, scope and subject of performance and, and if appropriate, other necessary data.

Legal basis:

Kielle processes personal data on the basis of its respectively the User’s legitimate interest to enforce existing rights or defend legal claims.

Storage period:

Personal data shall be processed in this manner for a period of 5 years from the date of commencement of personal data processing unless the legal regulations specify otherwise, or unless the need to store personal data for a longer period arises in a specific case.

 

4. Processing of access data when visiting the Website

Purpose:

Server log files are created and stored for the purpose of establishing and maintaining technical security.

Type and extent of data processing:

When accessing the Website, certain access data are processed automatically in so-called server log files; in particular, the following data are processed within this context: (i) name of visited Website; (ii) browser type/version used; (iii) operating system of the User; (iv) previously visited Website (referrer URL); (v) time of the server request; (vi) data volume transferred; (vii) host name of the accessing computer (IP address). This information does not allow kielle to identify Users personally; however, IP addresses are considered personal data.

Legal basis:

Kielle processes personal data on the basis of its legitimate interest to establish and maintain technical security.

Storage period:

Data contained in server log files are stored for a period of 5 years.

 

Other recipients of personal data

Personal data may be transferred to public authorities and contractual partners of kielle.

1. Public authorities

Kielle discloses personal data to public authorities only on the basis of instructions of the data subjects and also in cases where this is required by the law or on the grounds of protection of the legitimate interests of Kielle or third parties. Public authorities act as independent controllers of your respective personal data.

2. Contractual partners

Kielle may also transfer personal data to contractual partners if relevant and appropriate for the purpose of the respective processing activity. Contractual partners may either act as controllers themselves or as processer that are bound by our instructions.

Providers of services related to communication with customers

Kielle shares personal data with certain partners who help kielle in communicating with customers, e.g. by managing the contact form. Shared data may include first and last name, e-mail, telephone number.

Users’ rights

Right of access to personal data

Users have the right to obtain information on whether their personal data are processed and, if so, they also have the right to gain access to their personal data. If the Users have any queries or requests concerning the processing of their personal data, they may contact kielle.

Right to rectification of personal data

If the Users believe that kielle processes inaccurate or incomplete personal data, they have the right to request their rectification or supplementation.

Right to erasure

If the Users request erasure of their personal data, kielle shall erase their personal data if (i) they are no longer necessary for the purposes for which they were collected or otherwise processed; (ii) the User has withdrawn the consent to the processing of personal data, such personal data were processed on the basis of consent and there is no other legal ground for the processing; (iii) the User has objected to the processing and there are no overriding legitimate grounds for the processing of the User’s personal data; (iv) the processing is unlawful; or (v) the legal obligation to process the personal data based on European Union law or national law has ceased to exist.

Right to restriction of personal data processing

Until kielle resolves any disputable issues regarding the processing of the Users’ personal data, the Users have the right to request restriction of processing of their personal data. Where processing has been restricted, the Users’ personal data may be processed, except for their storage, only with the Users’ consent or for the purpose of establishing, exercising or defending legal claims, for the protection of third-party rights or for reasons of an important public interest of the European Union or any Member State.

Right to data portability

Users have the right to obtain personal data concerning them (i) which they provided to us; (ii) which are processed based on consent or contract; and (iii) which kielle processes by automated means; all that in a structured, commonly used and machine‑readable format, as well as the right to have such data transferred to another controller. However, if the exercise of this right would adversely affect the rights and freedoms of other persons, kielle will not be able to satisfy the Users’ requests.

Right to object

Users have the right to object to processing of personal data that are processed for the purposes of performing a task carried out in the public interest or in the exercise of official authority or for the purposes of protecting the legitimate interests of kielle or legitimate interests of third parties. If kielle subsequently fails to prove that there exist serious legitimate grounds for personal data processing which override the interests of Users or their rights and freedoms, or that kielle needs the processing for the establishment, exercise or defence of legal claims, kielle will terminate the processing on the basis of the objection without undue delay. Moreover, Users have an unconditional right to object to any processing of their personal data being executed for direct marketing purposes.

Right to withdraw

Users have the right to withdraw their consent granted for the processing of their personal data at any time. However, the withdrawal of Users’ consent does not retroactively affect the lawfulness of data processing based on such consent – it solely affects subsequent processing activities. After the exercise of said right, kielle will terminate the affected processing activities without undue delay.

Any requests regarding the assertion of any of the abovementioned rights or anyquestions concerning personal data processing will be answered to the Users shall be directed by e-mail at info@kielle.co.uk.

Kielle shall then answer Users’ requests as soon as possible and within one 1 month at the latest (in exceptional cases, restrictions on these rights are possible, for instance, if otherwise the rights of third parties would be affected).
